The Kazakh press has recently revealed information on reversing the sentence of Vasiliy Rosinov and on his complete liberation from criminal responsibility. So, the hardships of Ivolga’s former Head have ended. But in exchange for what?
We have commented on the problems of Ivolga-Holding’s former Head Vasiliy Rosinov’s and his longtime business partner Akhmetzhan Esimov (the Chairman of the Management Board of NWF Samruk-Kalyan and Nursultan Nazarbayev’s nephew) numerous times. The latest comments were presented on March 17, 2020, in the article «A Sentence for Rosinov But Not for Esimov».
It was written following the sentence passed on March 2, 2020, by Court № 2 of Kostanay that found businessman Rosinov guilty of violating Article 195, Part 4, Clause 2 of the Kazakh Criminal Code («Infliction of property damage via fraud or abuse of trust») and sentenced him to 2 years and six months of freedom deprivation.
During that time, Rosinov was to be on probation, in other words, he was not to leave the city without a special permission and change the place of residence. He also was prohibited from visiting places of entertainment and leave the house from 10 p.m. to 6 a.m. Violating this rules could have resulted in serving the rest of the sentence in prison.
However, the arrest placed on Rosinov’s properties by the Nur-Sultan investigative court was lifted and the properties were not confiscated.
In other words, the court was much more benevolent towards Vasiliy Rosinov than the state prosecution — back then, the prosecutor requested to restrict the accused’s liberty for the period of six and a half years (half of which were to be served at a medium-security penal colony), the confiscation of the property and the deprivation of all the state honours.
The reason for the benevolence of the Kazakh justice that we (and not just we) believe has become one of the most manipulated justice systems in the world lies, of course, in the tight connection (at least in the past) of the accused wilth Akorda’s «behind-the-scene architect», its «puppet master» Akhmetzhan Esimov.
We end our latest material with the following forecast.
«The fate of Vasiliy Rozinov is not hard to predict — he is going to serve his sentence (let us repeat that, by the Kazakh standards, it’s like a child’s play and is unlikely to impede on his current lifestyle) and will continue living his life in comfort.
As for the future of the Chairman of the Management Board of SWF Samruk-Kazyna, it is not hard to predict either. Even if Akhmetzhan Esimov is pensioned off or, on the contrary, gets a raise — for instance, becomes the Head of the Senate instead of his niece, he will nonetheless remain the „puppet master“ of Akorda».
Now then, we’ve made a mistake and we do acknowledge it. Recently, the Kazakh media and the internet-resources have informed the public that the appellate court overturned the verdict and reversed Vasiliy Rosinov’s sentence by completely liberating him from criminal responsibility.

«Today the appellate court has had a hearing related to the case of Ivolga-Holding’s former Head Vasiliy Rosinov. A new verdict has been reached, reports our correspondent.
The Articles were applied in their old wording. Initially, the big business was accused of fraud. However, later the charges were replaced with inflicting property damage via fraud for which he was sentenced to two and a half years. Today, the charges have been changed again. The entrepreneur has been found guilty of illegal receipt of a credit.
»Considering that the crime described in Article 194, Part 1 of the Kazakh Criminal Code (as in force in 1997) was committed during the period of 2011 — 2013 and belongs to the misdemeanour category as well as due to the fact that more than 7 years have passed since the crime was committed, the court liberates the accused from criminal responsibility due to the expiration of the limitation period in accordance with Article 71 of the Kazakh Criminal Code«, explains the press-service of the Kostanay Regional Court».
Thus, the business-problems of Vasiliy Rozivov are almost over since they are now part of the civil legal domain.
In our opinion, this story has confirmed yet again that Akhmetzhan Esimov has been, is and will be (for some time) such an influential force in Akorda and the Library that he even has the power to save the members of his clan (even former ones) from justice. Perhaps not as quickly as in the past but nonetheless… And this, apart from the other things, means that Mr. Rozinov, in his turn, will keep silent in re the contacts with Esimov which, given today’s conditions, means quite a lot as well.
